1. Purpose
These Terms of Sale govern all sales made by Maison Monéger to its customers through the website maisonmoneger.fr. Any order implies full acceptance of these Terms of Sale.
2. Products
Maison Monéger offers the following products for sale:
- Alcoholic beverages: red and yellow gentian liqueurs (50 cl)
- Book available for pre-order
Photographs and visuals on the website are provided for illustrative purposes only. Packaging may evolve without constituting grounds for order cancellation.
3. Alcohol sales and protection of minors
The sale of alcoholic beverages is strictly reserved for persons of legal drinking age. By placing an order, the customer confirms that they have reached the legal age required to purchase alcoholic beverages in their country of residence.
In accordance with applicable legislation:
- In France: the sale of alcohol to minors is prohibited (Article L.3342-1 of the Public Health Code).
- In Belgium: the sale of spirits to persons under 18 is prohibited.
Maison Monéger reserves the right to refuse or cancel any order in case of reasonable doubt regarding the buyer's age.
4. Orders
To place an order, the customer provides their full contact details, delivery address and the information required to process the order. Any applicable fees are indicated before confirmation.
The order becomes final after confirmation by the customer and receipt of full payment. Maison Monéger reserves the right to refuse any order that appears abnormal, abusive or fraudulent.
5. Prices
Prices are shown in euros, inclusive of all taxes (TTC), unless otherwise explicitly stated. Delivery fees are shown separately before the order is confirmed.
Prices may be changed at any time. The applicable price is that displayed at the time the order is confirmed by the customer.
6. Payment
Payment is made via a secure payment link through Stripe (credit/debit card).
In the event of a payment issue, Maison Monéger reserves the right to suspend or cancel the order concerned.
Products remain the property of Maison Monéger until full payment has been received (retention of title clause).
7. Pre-orders
Some products may be offered for pre-order, meaning they are not immediately available. Estimated availability dates are provided for guidance only.
In the event of significant delay, the customer will be informed as soon as possible. If the product is permanently unavailable, Maison Monéger will offer a full refund or an alternative solution at the customer's choice.
8. Delivery
Delivery is made to the address provided by the customer at the time of ordering.
Delivery areas: Belgium and metropolitan France. Delivery fees are calculated based on the destination, parcel weight and shipping method. The amount is communicated to the customer before final order confirmation. Delivery is carried out via Mondial Relay or La Poste, at the seller's discretion.
Delivery times are provided for guidance only. Maison Monéger cannot be held responsible for delays attributable to the carrier.
Age verification may be required upon delivery for alcoholic products.
The customer is required to check the condition of the parcel upon receipt and to note any apparent damage with the carrier.
9. Right of withdrawal
In accordance with applicable legislation, the customer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without needing to provide a reason.
To exercise this right, the customer should send an email to liza@maisonmoneger.fr stating their name, order number and the product(s) concerned.
Products must be returned in their original condition, unopened and unconsumed. Return shipping costs are borne by the customer, except in cases of error attributable to Maison Monéger.
Refunds are processed within 14 days of receiving the returned product or proof of shipment from the customer.
Excluded from the right of withdrawal: products unsealed for hygiene reasons and perishable goods.
10. Damaged products / errors / non-conformity
In the event of a damaged product, error or non-conformity, the customer should contact liza@maisonmoneger.fr with photographs of the product and packaging.
Maison Monéger will propose an appropriate solution: replacement, refund or other, depending on the circumstances.
11. Legal guarantees
Products benefit from the legal guarantees of conformity and guarantees against hidden defects, in accordance with applicable legal provisions.
12. Liability
Maison Monéger cannot be held liable in cases of product misuse, excessive alcohol consumption, or customer error (incorrect address, inaccurate information, etc.).
The customer is responsible for the proper storage of products after delivery.
13. Personal data
Personal data collected in connection with orders is processed in accordance with our Privacy Policy.
14. Force majeure
Maison Monéger cannot be held liable for failure to perform or delay in performing its obligations in cases of force majeure, defined as any external, unforeseeable and irresistible event within the meaning of applicable case law.
15. Applicable law and disputes
These Terms of Sale are governed by Belgian law, subject to mandatory rules applicable in the consumer's country of residence.
In the event of a dispute, the parties undertake to seek an amicable resolution as a priority. Failing this, the competent courts shall be seized in accordance with applicable rules.
